By accessing or using EcomImagePro's AI-powered image enhancement service, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, please do not use our service. These terms constitute a legally binding agreement between you and EcomImagePro.

EcomImagePro provides AI-powered image enhancement services specifically designed for e-commerce sellers and businesses. Our platform offers:

• AI-powered product image enhancement and optimization
• Background removal and replacement for product photos
• Image styling and marketplace-ready formatting
• Batch processing capabilities for multiple images
• Credit-based usage system with flexible pricing plans
• Integration-ready enhanced images for Shopify, Amazon, Etsy, and other platforms
• Professional-quality output suitable for commercial use

To use EcomImagePro, you must create an account and provide accurate information. By creating an account, you represent that you are at least 18 years old and have the legal capacity to enter into this agreement. You are responsible for:

• Maintaining the confidentiality of your account credentials and API keys
• All activities that occur under your account, including usage by team members
• Notifying us immediately at security@ecomimagepro.com of any unauthorized use
• Providing accurate, current, and complete information during registration
• Updating your account information promptly when changes occur
• Using strong passwords and enabling two-factor authentication when available

Credit System

• Each image enhancement operation consumes 1 credit from your account balance
• Credits are digital tokens with no cash value and are non-transferable between accounts
• Unused credits do not expire but are subject to account inactivity policies after 12 months
• We reserve the right to adjust credit pricing with 30 days advance notice to users
• Promotional credits may have different terms and expiration dates as specified
• Credits cannot be resold, transferred, or used outside of the EcomImagePro platform

Payment Processing

• All payments are processed securely through Stripe, our third-party payment processor
• All prices are displayed and charged in USD unless otherwise specified
• By purchasing credits, you authorize us to charge your selected payment method
• Failed payments may result in temporary service suspension until resolved
• You are responsible for any fees charged by your bank or payment provider
• We do not store your complete payment information on our servers

Refund Policy

Refunds for unused credits may be requested within 7 days of purchase according to our comprehensive Refund Policy. Refunds are subject to our review and applicable consumer protection laws. Please refer to our separate Refund Policy document for complete details on eligibility and procedures.

You agree to use EcomImagePro only for lawful, ethical purposes and agree not to:

• Upload or enhance illegal, harmful, offensive, or inappropriate content
• Create deepfakes, misleading content, or unauthorized representations of real people
• Infringe on intellectual property, trademark, or copyright rights of others
• Generate content that violates privacy rights or contains personal information of others
• Create content for harassment, bullying, discrimination, or hate speech
• Attempt to reverse engineer, decompile, or compromise our AI models or algorithms
• Use automated systems, bots, or scripts to abuse or overload our service
• Resell, redistribute, or white-label our service without explicit written authorization
• Upload malicious files, viruses, or content that could harm our systems
• Use the service to compete directly with EcomImagePro or develop competing services

Your Uploaded Content

You retain full ownership of all images and content you upload to EcomImagePro. By uploading content, you grant us a limited, non-exclusive license to process, enhance, and temporarily store your images solely for the purpose of providing our service. This license terminates when you delete the content or close your account.

AI-Enhanced Images

You own all rights to the AI-enhanced images created through our service. However, you are solely responsible for ensuring that your use of both original and enhanced content complies with applicable laws, does not infringe third-party rights, and meets the requirements of your intended use case (marketplace policies, etc.).

Our Intellectual Property

EcomImagePro retains all rights, title, and interest in our AI models, algorithms, software, trademarks, service technology, and platform. You may not attempt to extract, copy, reverse engineer, or recreate our AI capabilities. Our service name, logo, and branding materials are protected intellectual property.

Commercial Use Rights

Enhanced images may be used for commercial purposes including but not limited to: e-commerce listings, marketing materials, advertisements, and product catalogs. You are responsible for ensuring compliance with platform policies where images are used.

While we strive to provide reliable, high-quality service, we cannot guarantee:

• 100% uptime or continuous availability (target: 99.9% uptime)
• Specific quality outcomes or that results will meet your subjective expectations
• Continued availability of any particular feature or enhancement capability
• Compatibility with all image formats or technical specifications
• Processing speed guarantees during peak usage periods

We reserve the right to modify, update, suspend, or discontinue any aspect of our service with reasonable advance notice. Critical updates may be implemented immediately for security or legal compliance reasons.

To the maximum extent permitted by applicable law:

• Our total liability to you is limited to the amount you paid to EcomImagePro in the 12 months immediately preceding the claim
• We are not liable for any indirect, incidental, special, consequential, or punitive damages
• We do not warrant that our service will meet your specific business requirements or expectations
• You acknowledge that you use our service at your own risk and discretion
• We are not responsible for business losses, lost profits, or damages resulting from service interruptions
• Our liability does not extend to third-party actions or integration failures with other platforms

You agree to indemnify, defend, and hold harmless EcomImagePro, its officers, directors, employees, and agents from and against any claims, damages, losses, or expenses (including reasonable attorney fees) arising from or related to:

• Your use or misuse of our service or enhanced images
• Your violation of these Terms of Service
• Your violation of any third-party rights, including intellectual property rights
• Content you upload, enhance, or distribute using our service
• Your business activities or commercial use of enhanced images
• Any breach of representations or warranties made by you

Our collection, use, and protection of your personal information and uploaded content is governed by our Privacy Policy, which is incorporated into these terms by reference. We are committed to protecting your privacy and maintaining the security of your data in compliance with applicable data protection laws.

Either party may terminate this agreement:

• You may close your account at any time through your account dashboard
• We may suspend or terminate accounts for violations of these terms after appropriate notice
• We may terminate accounts for extended inactivity (12+ months) with 30 days notice
• Upon termination, your right to use the service ceases immediately
• You may download your enhanced images for 30 days after termination
• Accrued payment obligations and liability disclaimers survive termination
• Unused credits are forfeited upon voluntary account closure

Any disputes arising from these terms or your use of EcomImagePro will be resolved through the following process:

• Initial good faith negotiation through our support team
• Mediation through a mutually agreed upon mediator if negotiation fails
• Binding arbitration conducted on an individual basis (no class actions)
• Arbitration will be conducted under the rules of the American Arbitration Association
• These terms are governed by the laws of Delaware, United States
• Any legal proceedings must be conducted in Delaware state or federal courts

We may modify these terms from time to time. When we do, we will:

• Provide at least 30 days advance notice for material changes
• Post updated terms on our website at ecomimagepro.com/terms
• Send email notifications to all registered users about significant changes
• Update the "Last updated" date at the top of this document

Your continued use of EcomImagePro after the effective date of changes constitutes acceptance of the updated terms. If you do not agree to modified terms, you must discontinue use of our service.

If any provision of these terms is found to be unenforceable or invalid by a court of competent jurisdiction, the remaining provisions will remain in full force and effect. The unenforceable provision will be replaced with an enforceable provision that most closely reflects the original intent.

These Terms of Service, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and EcomImagePro regarding the use of our service and supersede all prior agreements and understandings.
